Sanctions of ancient monument defence and other legal consequences
Existing Hungarian legislation provides several legal means to protect architectural heritage. The scope of authority of the National Office of Cultural Heritage (hereinafter: NOCH) is publicly known as well as the fact that NOCH may generally order owners to protect or restore historic buildings and impose a fine on those violating the respective rules. Besides administrative sanctions, there are less known civil law and criminal law sanctions that may be imposed, however most of them can be applied or motioned by local municipalities, public prosecutors or the police, rather then NOCH. This study is addressed to briefly overview the system of sanctions in the field of building heritage and at the same time to mention legal sanctions regulated by other areas of law. Before starting to introduce the individual sanctions, it is important to note that in certain cases the qualification of building heritage in itself can be disputed. This study does not deal with rules on the protection of archaeology sites.
